Terms of Service

By accessing or using FXSynapse AI ("the Platform"), operated at https://fxsynapse-ai.vercel.app by K2026174513 (Pty) Ltd trading as FXSynapse AI ("the Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.

FXSynapse AI is an AI-powered chart analysis software tool that provides automated technical pattern recognition on forex and financial market charts. The Platform allows users to upload chart screenshots and receive AI-generated annotations, structural observations, and educational market analysis. The Platform is a software tool — not a financial service, signal provider, or investment advisor.

FXSynapse AI does NOT provide financial advice, investment recommendations, or trading signals.

All analysis generated by the Platform is for educational and informational purposes only. AI-generated output may contain errors, inaccuracies, or misinterpretations. You should never rely solely on this analysis for trading decisions.

Trading forex, commodities, indices, and CFDs carries significant risk. You can lose more than your initial deposit. Past performance does not guarantee future results. Always do your own research and consult a licensed financial advisor before trading.

You are solely responsible for your own trading decisions and any financial losses incurred. FXSynapse AI and its operators accept no liability for losses resulting from the use of this Platform.

FXSynapse AI is not a Financial Services Provider (FSP) and is not registered with the Financial Sector Conduct Authority (FSCA) of South Africa. We do not manage client funds, execute trades, or act as an intermediary to any financial product.

You must be at least 18 years old to use the Platform. You are responsible for maintaining the security of your account credentials. One account per person — shared or resold accounts will be terminated.

We reserve the right to suspend or terminate any account that violates these Terms or engages in abusive behaviour.

The Platform offers free and paid tiers. Paid plans are billed monthly or annually and provide access to additional features and scan allowances as described on the Pricing page.

Payments are processed by third-party providers (Yoco). By purchasing a plan or credit pack, you agree to the payment processor's terms. All prices are displayed in South African Rand (ZAR) unless otherwise indicated.

Refund Policy: Due to the digital nature of the service, refunds are generally not offered once scans have been consumed. If you experience a technical issue preventing delivery of purchased scans, contact us at fxsynapseai@gmail.com within 7 days for resolution.

We reserve the right to change pricing at any time. Existing subscribers will be notified 14 days before any price increase takes effect on their next billing cycle.

Platform Ownership: The FXSynapse AI platform — including its source code, algorithms, AI models, user interface design, branding, logos, email templates, marketing copy, and all visual assets — is the exclusive intellectual property of FXSynapse AI and its creators.

You may NOT:

• Copy, reproduce, or clone any part of the Platform's code, design, or functionality
• Reverse engineer, decompile, or attempt to extract the source code or AI prompts
• Resell, sublicense, or redistribute access to the Platform or its output
• Scrape, crawl, or use automated tools to extract data from the Platform
• Use the FXSynapse AI name, logo, or branding without written permission
• Create derivative works or competing products based on the Platform

Your Content: Charts you upload remain your property. By uploading, you grant FXSynapse AI a limited license to process and analyse your charts for the purpose of delivering the service. We do not claim ownership of your uploaded charts.

AI Output: Analysis results generated for your scans are licensed for your personal use only. You may not bulk export, resell, or redistribute AI-generated analysis as a commercial product or service.

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to the Platform, its servers, or other users' accounts
• Abuse the API or exceed rate limits intentionally
• Upload malicious files, scripts, or content designed to exploit the system
• Use the Platform to generate misleading content for fraud or market manipulation
• Share your account credentials or allow others to access your account
• Circumvent payment, scan limits, or any access controls

Violation of these terms may result in immediate account termination without refund.

The Platform is provided "as is" without warranty of any kind, express or implied. We do not guarantee uninterrupted access, accuracy of AI analysis, or fitness for any particular purpose.

We may modify, suspend, or discontinue any part of the Platform at any time without prior notice. Scheduled maintenance will be communicated where possible.

To the maximum extent permitted by law, FXSynapse AI and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to:

• Financial losses from trading based on AI analysis
• Loss of data, profits, or business opportunities
• Service interruptions or downtime
• Errors or inaccuracies in AI-generated output

Our total liability shall not exceed the amount you paid for the Platform in the 3 months preceding the claim.

FXSynapse AI offers an affiliate programme allowing users to earn commissions on referrals. Affiliate payouts are subject to verification and may be withheld if fraudulent activity is detected (e.g. self-referrals, fake signups, or manipulated traffic).

We reserve the right to modify commission rates, payout thresholds, or terminate the affiliate programme at any time.

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from the use of the Platform shall be subject to the jurisdiction of the courts of South Africa.
